New York DA says feds did OK in fatal shootout

HERKIMER, N.Y. (AP) An upstate New York district attorney has ruled that federal agents who gunned down a man that had fatally shot four people did nothing wrong in the attack.

In a June letter to FBI officials and the U.S. Marshals Service, Herkimer County District Attorney Jeffrey Carpenter says 64-year-old Kurt Myers wasn't killed unnecessarily by federal agents in March 2013.

Myers had barricaded himself in an abandoned building after the killing spree. An FBI Hostage Rescue Team entered the building the next morning, and Myers reportedly opened fire, killing a K-9 unit.

Four agents shot back, and Myers died after being struck multiple times.

Carpenter tells the Observer-Dispatch of Utica on Tuesday he declined to prosecute any agents involved in the shooting because it was justified based on the evidence.
